Privacy Notice Within the Scope of the Turkish Personal Data Protection Law No. 6698
As İME DC Sağlık Ürünleri Sanayi Ve Ticaret Limited Şirketi (“the Company’’), we show the utmost sensitivity to the security of the personal data of our employees, our customers, our business partners and every natural person with whom we have any other business relationship. With this awareness, as the Company we attach great importance to ensuring that all kinds of personal data belonging to all of our employees bound to us by an employment contract, to the business partners with whom we are in a service or purchase contract, and to our employees are processed and retained in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”). We process your personal data in the manner explained below, in accordance with the KVKK and within the limits prescribed by the legislation.
1. Collection and Processing of Personal Data and the Purposes of Processing
Your personal data may be collected by our Company, in connection with the contract between us; through automatic or non-automatic methods, verbally, in writing, digitally or electronically, at workplaces and in related areas. Your personal data may be processed, being created and updated, for as long as the contractual relationship or any obligations that may arise from the contract continue.
Data relating to individuals’ race, ethnic origin, political opinion, philosophical belief, religion, religious sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as their biometric and genetic data, are special categories of personal data. For employees who have an employment contract with the Company, your special categories of personal data relating to health and to criminal convictions and security measures are collected and processed within the limits of legal obligations, pursuant to the Labor Law No. 4857 and other applicable legislation and in accordance with the employment contract between you and the Company.
In the event that you are provided with an allocated mobile phone, vehicle or computer, your personal data may be processed for maintenance, repair and productivity purposes.
Your collected personal data will be processed for the purposes of fulfilling our contractual obligations, ensuring the continuity of the Company’s operations, organizing the work, fulfilling employer responsibilities, ensuring occupational safety, managing, supervising and performing the work, fulfilling our responsibilities with respect to public institutions and organizations, and ensuring the safety of employees, within the personal data processing conditions and purposes specified in the KVKK.
2. To Whom and for What Purposes Processed Personal Data May Be Transferred
The Company may transfer personal data for the purposes of fulfilling its contractual obligations, ensuring the continuity of the Company’s operations, organizing the work, fulfilling employer responsibilities, ensuring occupational safety, managing, supervising and performing the work, fulfilling our responsibilities with respect to public institutions and organizations, and ensuring the safety of employees, including but not limited to those about to be listed; personal data may be transferred, including but not limited to the following: to suppliers, business partners and business contacts; to law enforcement units, public institutions, and the relevant ministries and directorates; to public institutions and legal entities designated pursuant to the labor law and social security laws; and to public institutions authorized by law, within the framework of the personal data processing conditions and purposes specified in the KVKK.
3. Method and Legal Basis of Collecting Personal Data
Your personal data are obtained in all kinds of verbal, written, electronic or digital media, in line with the purposes set out above and primarily under the labor and social security laws and contractual rights and obligations, for the purpose of enabling the Company to fulfill, fully and accurately, its responsibilities arising under the legislation from its employment contract, from the service and similar contracts to which it is a party, and from the laws. Your personal data collected on this legal ground may also be processed and transferred for the purposes specified in this notice, within the scope of the personal data processing conditions and purposes specified in the KVKK.
4. Rights of the Data Subject Listed in Article 11 of the KVKK
If, as data subjects, you submit your requests concerning your rights to our Company in writing, our Company will, depending on the nature of the request and after verifying your identity, conclude the request within the periods specified in the Law, and within 30 (thirty) days at the latest.
Within this scope, data subjects have the following rights;
- To learn whether personal data are processed,
- To request information regarding their personal data if they have been processed,
- To learn the purpose of the processing of personal data and whether they are used in accordance with that purpose,
- To know the third parties to whom personal data are transferred, within the country or abroad,
- To request the rectification of personal data if they have been processed incompletely or inaccurately, and to request that the operation carried out in this respect be notified to the third parties to whom the personal data have been transferred,
- To request the erasure or destruction of personal data in the event that the reasons requiring their processing cease to exist even though they have been processed in accordance with the provisions of the KVKK and other applicable laws, and to request that the operation carried out in this respect be notified to the third parties to whom the personal data have been transferred,
- To object to the emergence of a result to their own detriment through the analysis of the processed data exclusively by means of automated systems,
- To request compensation for the damage in the event that they suffer damage due to the unlawful processing of personal data.
Pursuant to the KVKK Law, you are required to submit your request regarding the exercise of your rights stated above to our Company in writing.
